HOUSTON, TX – Nicole Alarcon and Agustin Alarcon are among five couples who have filed a lawsuit against a Houston IVF lab, alleging that it knowingly implanted dead or damaged embryos into patients. They spoke at a press conference on September 17, 2024, revealing their distress and frustration over the clinic’s practices.

The couple’s journey through in vitro fertilization (IVF) has been marked by disappointment. After three unsuccessful attempts to conceive—resulting in two failed transfers and one miscarriage—they were informed by a doctor that the embryos they had been using were damaged prior to implantation. This revelation came only weeks ago, despite the issues reportedly arising at the Aspire Houston Fertility Institute’s lab earlier in the year.

The lawsuit, filed in Harris County District Court, asserts that Aspire failed to notify the patients of a catastrophic failure in its Piney Point laboratory that happened around February or March. The lab attributed its failure to contaminated or defective freeze medium—a solution critical to embryo preservation—provided by CooperSurgical, the manufacturer involved in the IVF process.
